Terms, and Disclaimer
The RescueSync Service relies upon the accuracy of the information you supply. You therefore agree to defend, indemnify and hold RescueSync (including its employees, officers, directors and agents) harmless from any claim or lawsuit brought by member or others for injury, death, loss or damages arising in whole or in part out of your provision of incomplete or inaccurate information.
Privacy Policy
RescueSync is serious about protecting your privacy. Any information we collect is solely for the purpose of enhancing your RescueSync experience.
We may request personally identifiable data ("Personal Information") from you, including your e-mail address, domain name (where possible), address, and telephone number, and so on. In addition, our Web server automatically recognizes and stores visitors’ e-mail addresses or domain names (where possible) upon logging onto our Internet site (“Site”), e-mail addresses of persons who communicate with us via e-mail, and aggregate information about what pages on our Site users visit or access.
The Personal Information described above is collected solely by RescueSync. We use e-mail to communicate with you about RescueSync offers and to apprise you of special promotions and company news. We use Personal Information to help serve you more effectively, to improve the content of our Web pages, to customize the content and/or layout of our pages, to notify consumers about updates to our Site, and/or to contact consumers for marketing purposes.
By using this Site, you are agreeing to the terms set forth in RescueSync’s privacy policy. RescueSync reserves the right, at its discretion, to change, modify, add, or remove portions of this policy at any time. Please check this page periodically for changes. IF YOU USE THIS SITE FROM OTHER LOCATIONS, YOU ARE RESPONSIBLE FOR COMPLYING WITH ANY AND ALL APPLICABLE LOCAL LAWS. Security
We use reasonable precautions to protect our customers' personal
information and to store it securely. Sensitive information that is transmitted
to us online (such as credit card number) is encrypted and is transmitted to us
securely. In addition, access to all of our customers' information, not just
the sensitive information mentioned above, is restricted. Only employees who
need the information to perform a specific job (for example, a billing clerk or
a customer service representative) are granted access to personally
identifiable information. Finally, the servers on which we store personally
identifiable information are kept in a secure environment.
Cancellation of your
account
If you choose to terminate your RescueSync service we ask that you notify us by calling customer service at 1-866-601-5465 and destroy your RescueSync materials. This action will stop any confusion and/or misrepresentations associated with your account.
E-mail Newsletters
If users wish to subscribe to our e-mail newsletters, we ask for contact
information (such as name, e-mail address and, occasionally, demographic
information). We use this information in the same manner as we use contact
information in the registration and ordering process described above.
Recipients of our newsletters can unsubscribe using the instructions listed at
the end of the e-mail newsletter.
Communications from Us: Service Updates, Special
Offers
In order to best serve our customers, we may send updates that contain
important information about our products and services. For example, we send new
members a welcoming message and instructions for our password-protected system.
We may also communicate with a customer to provide requested services and for
account-related issues via e-mail, phone or regular mail. In addition to such
service and product-essential messages, we offer our customers the option to
receive information about our company, related products, services and special
deals.
Copyright information
All information, including but not limited to the text, images, audio, or video contained herein, belong to RescueSync and may not be used in any manner, or for any purpose, without Rescue Sync’s express written permission, except as provided for herein. Without in any way waving any of the foregoing rights, RescueSync allows users to download a single copy of the material on this Site for personal, noncommercial home use only, provided users do not delete or change any copyright, trademark, or other proprietary notice. Modification or use of the material on this Site for any other purpose violates RescueSync’s legal rights. Trademark
RescueSync.com and When Life and Your Information Need to Cross are trademarks of RescueSync. All other trademarks and/or service marks used on the Site belong to their respective third-party owners. Nothing on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark and/or service mark displayed on the Site without the written permission of RescueSync or third-party owners. Users acknowledge that RescueSync aggressively enforces its intellectual property rights to the fullest extent of the law, including, without limitation, the seeking of criminal prosecution.
Permissions
Our customers are given the opportunity to choose whether to receive
information from us. Customers also have the opportunity to choose whether to
have personal information shared with third parties for marketing purposes.
Customers also can call customer service to change their preferences.
In addition, for those customers that are California residents, you may have additional rights, as described in the "Your California Privacy Rights" section below.
Please note that we will endeavor to implement your permission requests within a reasonable time, although for a time you may continue to receive mailings, etc., transmitted based on information released prior to the implementation of your request. In addition, please note that even after such request is implemented, you will continue to receive information directly related to the product or service for which you registered (or which you otherwise agreed to receive), so you always are kept informed.
Your California privacy rights
Beginning on January 1, 2005, California Civil Code Section 1798.83 permits
those customers that are California residents to request that RescueSync not
share your personal information with third parties for their direct marketing
use.

Miscellaneous
This Agreement is entered into in the state of Washington and is governed by and construed in accordance with the laws of the state of Washington, exclusive of its choice of law rules. Each party to this Agreement submits to the exclusive jurisdiction of the state and federal courts sitting in the city of Seattle in the state of Washington, and waives any jurisdiction, venue, or inconvenient forum objections to such courts. In any action to enforce this Agreement, the prevailing party is entitled to costs and attorneys' fees. In the event that any of the provisions of this Agreement are held to be unenforceable by a court or other tribunal of competent jurisdiction, such provisions will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable.
General terms
This Agreement constitutes the entire agreement between the parties hereto pertaining to the subject matter hereof and any and all prior or contemporaneous written or oral agreements existing between the parties hereto are expressly canceled. No waiver by either party of any breach or default hereunder may be deemed to be a waiver of any preceding or subsequent breach or default. Any heading, caption, or paragraph title contained in this Agreement is inserted only as a matter of convenience and in no way defines or explains any paragraph or provision hereof.
